Prior to booking a retreat with us, please read and ensure you understand the terms and conditions of booking below. We also recommend you read your SFR Information Pack in detail, prior to the retreat start date.
All bookings are made with Starks Fitness & Nutrition Limited (us/we/our) trading as SF Retreat (SFR). By booking a retreat with SFR you are deemed to have agreed to these terms and conditions (such terms and conditions constituting the entire agreement between you and SFR).
All retreat dates shown on the website are valid until 31 December 2021. Thereafter, dates are indicative only.
To confirm your booking you will be required to pay a non-refundable deposit of £300 per person per retreat. If your booking is made within 56 days of the retreat start date, then the full amount is payable at the time of booking.
CONFIRMATION & BALANCE PAYMENT
Once your booking has been accepted by SFR, SFR will issue a confirmation invoice and SFR Information Pack, to the email provided at the time of booking. Your invoice will also set out payment details for payments of your outstanding balance, which shall be due no later than 56 days prior to the retreat start date.
The advertised prices for each retreat are subject to variable and seasonable pricing, in line with standard market practice. As such, retreat prices may vary from time to time in accordance with season, demand and market conditions. The price of your retreat will be secured upon payment of your deposit. Any discounts that become available after you have paid your deposit, cannot be applied to your balance.
If you cancel your booking, the following cancellation fees will apply:
· 56 days or more prior to the retreat start date – SFR will retain your deposit;
· between 55 and 43 days prior to the retreat start date – SFR will retain your deposit and 50% of the balance;
· between 42 and 29 days prior to the retreat start date – SFR will retain your deposit and 50% of the balance; and 28 days prior to the retreat start date – SFR will your deposit and 100% of the balance.
If you are required to leave a retreat before the retreat end date, you will not be entitled to a refund for the remaining unused duration.
SFR may be required to cancel a retreat in the following circumstances:
· there are less than 10 anticipated attendees 28 days prior to the retreat start date;
· Force Majeure; or other events beyond SFR’s reasonable control that means it is not viable to proceed with the relevant retreat.
If SFR has to cancel your retreat, SFR will tell you as soon as possible and will offer you a choice of transferring to alternative retreat date.
SFR will not be liable for any incidental expenses incurred in connection with your booking (e.g. visas, vaccinations, travel insurance excess and non-transferrable flights).
Subject to your (a) payment of a £100 transfer fee , and (b) written notice at least 56 days prior to the retreat start date, you may be able to transfer from one retreat to another and/or transfer your booking into the name of an alternative attendee.
Unless otherwise specified at the time of booking, all retreats will take place at the Venue: Quinta Do Rabacal, Tabua, Portugal. You acknowledge that the Venue is owned and maintained by a third party (Venue Owner).
References to the Venue shall be deemed to include all accommodation, facilities (including but not limited to the training facility and equipment therein, and equipment made available for the purposes of the Optional Activities.
The venue has a check out policy which requires guests to vacate their accommodation, no later than 4pm: an earlier time of 2pm was specified in the previous draft T&Cs – it would be sensible to consider this time with reference to the time of departure required for Bristol flights] local time, on the retreat end date. It may be possible to agree a later check out date with the Venue Owner at their absolute discretion. Any such late check outs may be subject to additional charges.
The retreat price includes (for the duration of the retreat):
· all scheduled training sessions (as specified in the SFR Information Pack);
· all meals (as specified in the SFR Information Pack);
· unlimited SFN supplements; and
· the Optional Activities.
The following Optional Activities will be available at the Venue:
· mountain biking;
· hiking; and
· swimming (river and pool).
· ADDITIONAL CHARGES
During the retreat, it may be possible to purchase massage therapies and private 1-2-1 appointments with the coaches. These sessions will be subject to additional charges as set out in the SFR Information Pack. If you fail to settle your account prior to departure, you will be required by SFR to pay, in addition to the outstanding amount, an administration fee equal to 25% of the outstanding amount.
AGE & HEALTH
All attendees must be aged 18 or over at the retreat start date. SFR does not have an upper age limit but remind you that some of the training sessions will be physically demanding so all attendees must ensure that they are suitably fit to allow full participation.
PASSPORTS & VISAS
It is your responsibility to ensure that you have obtained all necessary passports and visas prior to the retreat start date, to enable you to attend the retreat. SFR will not be liable if you are refused entry to Portugal because you lack the correct passport, visa or other required travel documentation.
It is your responsibility to ensure that you have obtained appropriate travel insurance prior to the retreat start date. Your insurance must cover against personal accident, death, medical expenses and emergency repatriation and we recommend minimum coverage of £200,000. SFR strongly recommend your insurance also covers cancellation, curtailment, personal liability and loss of luggage / personal effects. Please ensure you bring details of your travel insurance policy and
emergency contact number with you on the retreat.
Each retreat will have a specified Retreat Director, who will be introduced to all attendees at the welcome talk. The decision of the Retreat Director is final on all matters likely to affect the safety or wellbeing of any attendee, coach or staff member on the retreat. If you fail to comply with a decision made by the Retreat Director, the Retreat Director may direct you to leave the Venue and the retreat immediately, with no right of refund.
All retreat attendees must refrain from (a) any illegal act (b) conduct or use of language which may give rise to offence being taken by other attendees, local residents, SFR , the Venue Owner, and/or their employees or agents, and (c) causing damage to the Venue and/or any personal property. If the Retreat Director becomes aware of any such conduct, they may in their absolute discretion, ask you to leave Venue and the retreat immediately with no right of refund.
You acknowledge that the nature of the trip is extremely active and participation in both the scheduled training sessions and Optional Activities, involves a degree of personal risk.
LIMITATION OF LIABILITY
SFR will not be liable for any damage or loss as a result of a breach of these terms and conditions, where such damage or loss is (a) directly attributable any act or commission by you (b) attributable to any third party unconnected with SFR or the Venue Owner (c) due to unavoidable and extraordinary circumstances beyond SFR’s control, and (d) Force Majeure. SFR cannot accept liability for delayed transport arrangements and /or missed transport if you or any member of your group misses a flight or other transport arrangement or if your transport is delayed. In the case of flights, in some circumstances under EU law, you may be entitled to refunds or compensation from the airline. Further information is available on this from the Civil Aviation Authority at www.caa.co.uk/passengers.
Neither SFR nor the Venue Owner, their employees or agents will be liable for any loss or damage to any personal property or vehicle belonging to you during the retreat, save where such loss or damage is directly attributable to their negligent act or commission.
Nothing in these terms and conditions shall limit SFR’s liability for (a) death or personal injury caused by the negligence of SFR or its employees, and/or (b) fraud or fraudulent misrepresentation.
If you experience any problems during the retreat and wish to make a complaint, please report in the first instance to the Retreat Director. In the unlikely event that the problem is not resolved by the Retreat Director, the complaint should then be escalated to SFR’s Complaints Officer, James Stark, as soon as reasonably practicable but not later than 7 days after the retreat end date. Failure to provide notify the Retreat Director and/or SFR’s Complaints Officer will preclude you from being entitled to take any further action against SFR.
In the event that any one or more provisions contained in these terms and conditions is deemed void or unenforceable by law, then such provision shall be severed from the contract or amended accordingly only to such extent necessary to allow all remaining provisions to continue in full force and effect.
During the retreat, SFR or an agent of SFR may photograph and/or video you. You consent to SFR using these
images for the purposes of social media, publicity, and advertising. You hereby grant SFR a non-exclusive,
irrevocable and loyalty free licence to use these images for such purposes.
If required during your retreat, SFR will provide you with appropriate information on health services together with
any such reasonable travel required to seek assistance from medical professionals, as soon as reasonably
SFR is required by the Packgage Travel and Linked Travel Arrangements Regulations to ensure any monies paid by
you for any retreat, is secured in the event of our insolvency prior to or during your retreat.
For the purposes of these terms and conditions, Force Majeure shall mean any event beyond SFR or the Venue Owner’s reasonable control, including but not limited to (a) acts or threat of terrorism (b) civil strife (c) significant risk to human health such as outbreak of serious disease at or around the Venue and/or Portugal (d) natural disasters such as fire, flood, earthquake or weather conditions which render it impossible to travel to or remain at
the Venue safely (e) war or threat thereof (f) any residual consequences of the aforementioned.
GOVERNING LAW & JURISDICTION
These terms and conditions are governed by the laws of England and Wales. In the event of any dispute between you and SFR, both you and SFR submit to the exclusive jurisdiction of the courts of England and Wales.
